SIOUX FALLS, S.D. ? State prosecutors filed notice Friday that they will seek the death penalty against two inmates charged with killing a correctional officer at the South Dakota Penitentiary.
Rodney Berget and Eric Robert have pleaded not guilty to murder and are scheduled to stand trial in July.
Authorities say they attacked and killed 63-year-old Ronald Johnson in a work area inside the Sioux Falls prison and then used his uniform in an unsuccessful escape attempt April 12.
Attorney General Marty Jackley said the crime fits five of the 10 conditions set in state law that qualify for the death penalty. They are the death of a correctional officer, the manner of death, where and why it occurred, and the defendants? criminal background.
